Plazo para descuentos de INFONAVIT conforme al artículo 29 reformado

El pasado 21 de febrero de 2025 se publicó en el Diario Oficial de la Federación (DOF) el Decreto por el que se reforman, adicionan y derogan diversas disposiciones de la Ley del Instituto del Fondo Nacional de la Vivienda para los Trabajadores (INFONAVIT) y de la Ley Federal del Trabajo (LFT), en materia de vivienda con orientación social.
Una de las reformas más relevantes establece que los descuentos a que se refiere la fracción III y el segundo párrafo del artículo 29 de la Ley del INFONAVIT no se suspenderán en caso de ausencias o incapacidades, en términos de la Ley del Seguro Social.
Plazo para implementación por parte de los patrones
Aunque el decreto establece que las reformas entrarían en vigor al día siguiente de su publicación, el Consejo de Administración del INFONAVIT emitió un aviso oficial reconociendo la necesidad de otorgar un plazo razonable de adaptación, para que los patrones realicen los ajustes necesarios en sus sistemas y procesos administrativos internos.
De acuerdo con el aviso publicado por el Consejo de Administración del INFONAVIT, con base en la Resolución RCA-14500-03/25 del 19 de marzo de 2025, se reconoce un plazo razonable para que los patrones realicen los ajustes necesarios a sus sistemas y procesos administrativos para implementar la reforma al artículo 29.
Esta disposición deberá aplicarse a partir del pago de salarios del cuarto bimestre de 2025 (julio y agosto), con fecha límite de entero el 17 de septiembre de 2025.
¿Qué deben hacer los patrones?
Actualizar sus sistemas para que los descuentos INFONAVIT no se interrumpan por incapacidad o ausencia.
Adecuar procesos administrativos y tecnológicos para cumplir con la reforma.
Estar preparados para aplicar los descuentos conforme a la nueva disposición a partir del pago de salarios de julio y agosto 2025.
